Terms of Service

Version 2026-09-25

These terms apply between PERSO (Robin Scheiwiller, sole proprietorship, Am Oeliweiher 2, 8625 Gossau ZH, Switzerland) and the company that uses PERSO (the customer). They take effect when a person accepts them for the customer.

1. For businesses only

PERSO is offered to companies and people acting for their business, not to consumers. The person who accepts these terms confirms that they may bind the customer.

2. What PERSO does

PERSO helps the customer write to business contacts. It reads what is publicly or lawfully available about a contact, drafts messages with AI, and, where the customer has set this up, carries out steps of a sequence (such as a profile visit, a like, a connection request, a message or an email) from accounts the customer has connected.

Every step runs in the customer's name and from the customer's own accounts. PERSO is a tool the customer operates; it does not act for itself.

3. The customer's accounts on other platforms, including LinkedIn

The customer connects its own accounts (for example LinkedIn, Sales Navigator, a mailbox or a CRM) and remains solely responsible for them. The customer is responsible for complying with the terms, policies and limits of each platform, including the LinkedIn User Agreement, and decides whether and how to use PERSO with them.

Platforms may restrict, limit, suspend or close an account, or remove content or contacts, at their own discretion and without warning. PERSO takes over no part of this risk. PERSO is not liable for any such measure or its consequences, including lost accounts, contacts, messages, reach or business.

The daily limits, pacing and pauses PERSO applies are a help to use a platform with care. They are not a promise that a platform will accept the activity.

LinkedIn and Sales Navigator are trademarks of LinkedIn Corporation. PERSO is not affiliated with, endorsed by or sponsored by LinkedIn or any other platform it connects to.

4. Lawful outreach

The customer decides whom it contacts, with what content and how often, and is responsible for doing so lawfully. This includes having a legal basis for processing each contact's data, the rules on unsolicited advertising (for example Art. 3 para. 1 lit. o of the Swiss Unfair Competition Act or § 7 of the German UWG), informing contacts where the law requires it, and honouring every objection or request to stop at once.

For the personal data of its contacts the customer is the controller and PERSO its processor. The Data Processing Agreement is part of these terms.

5. AI written content

Drafts are written by AI and can be wrong, incomplete or unsuitable. The customer reviews what it sends and is responsible for every message sent from its accounts, including messages sent by steps the customer chose to let PERSO carry out without a separate approval.

6. Fair use

The customer does not use PERSO to send spam, to harass or deceive anyone, to send unlawful content, to impersonate others, or to collect data beyond what its outreach needs. It does not try to get around PERSO's limits, share log in details, or copy, resell or reverse engineer the service.

7. The customer's data

The customer keeps all rights in the data it brings to PERSO and in the messages written for it. PERSO uses that data only to provide the service to that customer, as set out in the Data Processing Agreement. What PERSO learns from a customer's edits and replies stays within that customer's workspace.

One exception, which is about companies and not about people: once the addresses of at least five different people at one company show the same format (for example first.last), PERSO keeps that format for the company's domain and uses it for all customers. It is stored without any name, address or reference to the customer it came from.

8. Prices and payment

Prices are those shown on getperso.com/pricing when the order is placed, exclusive of VAT where VAT applies. Subscriptions are billed in advance for the chosen period. PERSO may change prices with at least 30 days notice before the next period; the customer may cancel before the change takes effect.

9. Term and ending

The agreement runs for the subscription period and renews unless cancelled before the end of the period. Either side may end it for a serious breach that is not remedied within 14 days of notice. PERSO may suspend access at once where use puts others, the service or the law at risk.

After the end, the customer can export its data for 30 days. PERSO then deletes it, except where the law requires it to be kept.

10. Availability

PERSO aims for the service to be available and working, but does not guarantee uninterrupted operation. Maintenance, changes by platforms PERSO connects to, and outages of providers can limit it.

11. Liability

PERSO is liable without limit for damage caused intentionally or by gross negligence, and where the law does not allow liability to be limited.

Otherwise, and as far as the law allows, PERSO's liability for slight negligence is excluded, and PERSO is not liable for indirect or consequential loss, lost profit, lost data, or the measures of any platform described in section 3. In any case PERSO's total liability is limited to the fees the customer paid in the twelve months before the event that caused the damage.

12. Indemnity

The customer holds PERSO harmless against all claims of third parties, including platforms, recipients and authorities, and the reasonable costs of defending them, that arise from the customer's use of PERSO, the messages it sends, or its breach of these terms, a platform's terms or the law.

13. Confidentiality

Both sides keep confidential what they learn about the other's business through this agreement, during it and afterwards.

14. Changes

PERSO may change these terms for good reason. The customer is told in advance and asked to accept the new version; if it does not, it may end the agreement at the end of the current period.

15. Law and courts

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The courts of Zurich, Switzerland, have exclusive jurisdiction.
